Privacy Policy
Effective date: · Last updated:
Moduba (“Moduba,” “we,” “us,” or “our”) is operated by MDBA Inc., a Delaware corporation. ModubaMedia.com (the “Site”) is operated by MDBA Inc. in connection with the Moduba brand and its advertising, marketing, media, promotional, and brand partnership activities.
This Privacy Policy describes how information is handled on the Site — a business-to-business website for brands, agencies, and other prospective partners. It applies only to the Site and does not apply to the separate Moduba consumer platform.
1. Information We Collect
Information you choose to provide
You may voluntarily provide information when you contact us or ask to meet with us — for example through the Site’s contact options, the meeting scheduler, email, or KakaoTalk. Depending on how you reach us, this may include your company name, your name, role or title, business email address, company website, market segment, business goals, an estimated budget range, scheduling details, and the contents of your message.
Information collected automatically
The Site does not offer user accounts, registration, or login. When you visit, the Site, the infrastructure that hosts and delivers it, and third-party services that support it may automatically collect or receive technical and usage information such as: IP address; browser and device information; approximate location derived from IP address; referring source or URL; campaign parameters contained in the links you follow; pages viewed and interactions with the Site; and timestamps and similar internet or network activity information. The technologies involved, and the choices available to you, are described in “Cookies, Analytics, and Similar Technologies,” and this information is used for the purposes described in “How We Use Information.”
2. How Our Contact Forms Work
The Site’s message forms work differently from most website forms: they prepare an email in your own email application. The information you type is used on your device to compose that email. The Site does not transmit or store what you type, and no information reaches Moduba unless you choose to send the email.
If you send it, your message travels through your own email provider and arrives at Moduba as an ordinary business email, which we then handle as described in this Policy.
3. How We Use Information
Information you voluntarily send to Moduba may be used to: respond to your inquiry; evaluate potential partnerships; schedule and conduct meetings; prepare proposals; provide information you request; manage prospective and existing business relationships; follow up after inquiries and after meetings; conduct reasonable sales and business-development communications; maintain prospective and existing business relationships; send additional relevant information; send marketing or promotional communications where permitted by applicable law; maintain records of business communications; prevent fraud or abuse; protect legal rights; and comply with applicable legal obligations.
Information collected automatically is used to: operate, maintain, and secure the Site; understand how the Site is used; improve our content and user experience; measure the effectiveness of our marketing; understand our audiences; where legally permitted, identify potential business interest in Moduba; and support our sales and business-development activities.
Where applicable law requires consent for a particular communication, or gives you the right to opt out or unsubscribe, we respect those requirements. You may opt out of marketing communications at any time by contacting legal@moduba.com or using any unsubscribe mechanism included in the communication.
5. Meeting Scheduling (Zcal)
The Site embeds Zcal, a third-party scheduling service, so you can book a meeting with us. When the booking interface loads, your browser communicates with Zcal’s servers, and Zcal may receive standard technical information such as your IP address and browser and device information, along with any information you voluntarily enter in the booking interface — such as your name, email address, and scheduling details.
Zcal operates under its own terms and privacy practices, which we encourage you to review. When you book a meeting, Moduba receives the booking information through our scheduling account, calendar invitations, and related notifications, and we use it to prepare for and conduct the meeting and as otherwise described in this Policy.
6. KakaoTalk
The Site offers KakaoTalk as a way to contact us. These are simple external links: the Site does not load any Kakao software development kit, tracking script, or pixel, and no information is transmitted to Kakao merely because you view a page containing the link. If you choose to click a KakaoTalk link, you will interact with Kakao’s platform, and Kakao’s own terms and privacy practices apply to that conversation. Messages you send us on KakaoTalk are received and handled by Moduba as business communications under this Policy.
8. Third-Party Websites and Services
The Site links to and embeds third-party websites and services, including Zcal and KakaoTalk, and content on the Site is delivered with the help of hosting and infrastructure providers. Third parties’ privacy practices are governed by their own policies, and — to the extent permitted by applicable law — Moduba is not responsible for the independent practices of services it does not control. We encourage you to review the privacy policies of any third-party service you use.
9. Data Retention
We retain business communications and related information for as long as reasonably necessary for the purposes described in this Policy — including responding to your inquiry, maintaining the business relationship, conducting reasonable follow-up, maintaining appropriate business and legal records, resolving disputes, enforcing agreements, preventing fraud and maintaining security, establishing, exercising, or defending legal claims, and complying with legal obligations — and for other legitimate purposes permitted by applicable law. Where applicable law requires deletion or prescribes a particular retention rule, applicable law controls.
10. Security
We use, and require our service providers to use, reasonable administrative, technical, and organizational measures designed to protect the information we handle. No method of transmission or storage can be guaranteed completely secure, however, and we cannot promise absolute security. If you believe your interaction with us has been compromised, please contact legal@moduba.com.
11. International Processing
Moduba is operated from the United States, and the Site is intended for business visitors in both the United States and the Republic of Korea. Information sent to us, and information processed by our service providers, may be processed in the United States or other countries whose data-protection laws may differ from those of your jurisdiction. Where applicable law imposes requirements on such processing, we handle information in accordance with those requirements.
12. U.S. State Privacy Rights
Several U.S. states have comprehensive privacy laws that grant residents rights over their personal information. These laws apply only where their thresholds and conditions are met, and given the nature and scale of the Site, they may not currently apply to MDBA Inc. We nonetheless describe the commonly provided rights, and we will honor requests as required by any law that applies to us:
- the right to know or access personal information;
- the right to correct inaccurate personal information;
- the right to delete personal information;
- the right to obtain a portable copy of personal information;
- the right to opt out of the sale of personal information, the sharing of personal information for targeted advertising, and certain profiling, where applicable law provides that right;
- the right not to receive discriminatory treatment for exercising privacy rights; and
- where provided by law, the right to appeal a refusal of a request.
Where a law granting these opt-outs applies to our processing, we will provide the legally required opt-out methods, including recognition of universal opt-out signals such as the Global Privacy Control where required.
To make a request, contact legal@moduba.com. We may need to verify your identity, and we will respond within the timeframe required by applicable law. If your request is refused and an appeal right applies, you may appeal by replying to our decision at the same address.
13. Notice to Individuals in the Republic of Korea
The Korean-language version of the Site is intended for businesses located in the Republic of Korea. This section applies to individuals in Korea whose personal information is processed in connection with the Site, and applies notwithstanding anything to the contrary elsewhere in this Policy. Nothing in this Policy waives rights that mandatorily apply under the Personal Information Protection Act of Korea (“PIPA”) or other applicable Korean law.
What is processed and why
Moduba processes the categories of information described in this Policy — business contact and inquiry information you choose to send us, meeting-booking information, and the ordinary technical information processed by website infrastructure — for the purposes described in “How We Use Information”: handling inquiries, evaluating and managing partnerships, scheduling meetings, maintaining business records, and meeting legal obligations. The ordinary technical information described above may be processed using the analytics, measurement, and related technologies described in “Cookies, Analytics, and Similar Technologies,” with the help of third-party service providers, including providers located outside of Korea.
Retention and destruction
Information is retained in accordance with the purpose-based standard in “Data Retention” and is destroyed or irreversibly de-identified without undue delay once the purpose of processing has been achieved, unless further retention is required or permitted by applicable law.
Processing by service providers and overseas processing
As described above, Moduba uses third-party service providers — including scheduling, hosting, content-delivery, and email services — that process information on our behalf. Moduba operates from the United States, and these providers may process information outside of Korea, including in the United States. Where PIPA imposes notice, consent, or other requirements on entrustment of processing or on the transfer of personal information abroad, we handle such processing in accordance with those requirements.
Your rights
Subject to applicable Korean law, you may request access to your personal information, correction of inaccurate information, deletion, or suspension of processing, and you may withdraw consent where processing is based on consent. To exercise these rights, contact legal@moduba.com. We will respond in accordance with applicable Korean law, and exercising your rights will not result in disadvantageous treatment. You may also seek redress through the mechanisms provided by Korean law, including dispute-mediation procedures.
Privacy contact
Privacy inquiries, including all requests under this section, may be directed to legal@moduba.com.
14. Children’s Privacy
The Site is a business-to-business website intended for companies and business professionals. It is not directed to children, and we do not knowingly collect personal information from children. If you believe a child has provided personal information to us, please contact legal@moduba.com and we will take appropriate steps to delete it.
15. Changes to This Privacy Policy
We may update this Privacy Policy from time to time as our business practices, technologies, service providers, analytics or advertising tools, legal requirements, or Site functionality evolve. The “Last updated” date at the top of this page shows when it was most recently revised, and material changes will be reflected on this page. Changes operate prospectively as legally appropriate: they do not retroactively remove rights you hold under applicable law, and we will not materially repurpose previously collected information where applicable law prohibits it.
16. Contact
Questions about this Privacy Policy or our privacy practices may be directed to legal@moduba.com. The Site is operated by MDBA Inc. in connection with the Moduba brand.
